passed legislation in 1870 acknowledging the ju day yoe christian tradition. americans officially got the day off from work. everything was swell up until about ten years ago when creeping secularism and pressure groups like the aclu began attacking the christmas holiday. they demanded the word christmas be removed from advertising and public displays and many people caved into that. now we have the happy holidays syndrome. what's interesting this year is that hanukkah will be over on thursday so there is no more holidays between then and christmas day. it's just christmas if you want to invoke happy. bad news for the secular progressives. the absurdity of the situation was parodied today in the

cartoon strip by bruins tice ti. then there is macy's, a company that i generally like because it supports wounded warriors. this year they're touting santa claus who will help you with your, quote, holiday wishes. so what holiday is santa celebrating? winter soul tis, the birthdays of a reign deer? what. there are three groups trying to diminish christmas, the american civil liberties union and the american humanist association. the most agreg sieve is the freedom from religion foundation which routinely threatens to sue school districts if they dare utter the word christmas. the irony is that nobody is bothering the atheists. they are free to celebrate whatever they want.

they are free not to believe and snicker at anybody who does believe. that's not good enough for these people. they want to banish any mention of jesus in the public square. they're the 0 pressers so why are we allowing anti-christmas madness. 47 percent of americans believe there is a war on christmas. 40 do not and 13 percent are confused. once again i will keep on eye on the situation. helping me is the alliance defending freedom organization based in scottsdale, arizona. they have been successful in defending traditional rights in the courts. therefore i say to them, god bless you, each and every one, with apologies to dickens. let's go to arizona and bring in doug napper, an attorney who works for the alliance

organization. what cases are you working on this season? >> the majority of americans celebrate christmas so everybody should have the right to enjoy the season without the inter feerns of a few bullies. we have seen basis where schools have banned music based on information put out by these organizations that don't understand the constitutionality of christmas. there were two cases, one in wisconsin and new jersey which you talked about where they banned the christmas carols and last one was in south carolina where it was a school ban, just music. they said, well, even though the students picked these songs, joy to the world and oh, come faithful, they banned them from the schools. alliance defending freedom sent a letter, told the truth about christmas, that christmas is constitutional and they allowed these back in the schools. >> let me stop you there. this is rock hill, south carolina, a suburb of charlotte, north carolina, right on the

boarder. what prompted the school officials here in a small town to say, we're not going to allow christmas music. were they threatened? did somebody come and shake them? what precipitated that? >> what is happening to this school and others is that they're getting miss information from groups like the aclu and freedom from religious foundation and they are telling things about christmas that aren't true. >> give me an example. >> well, they're saying you can't have christmas carols in the school, the students can't sing religious music in the schools. every federal court that reviewed this issue said you can. you're doing a great job of getting the information to the public. we sent out 13,000 letters to school students to tell the truth about christmas. >> this isn't a new story. this has been going on for decades as i pointed out. you guys have won pretty much

every case that you brought into court, correct? >> sure. what we're seeing now is they're not even bringing these cases to court. they're sending out threatening letters with misinformation in them. >> with all of that known that you have won and the federal courts have upheld the christmas traditions, why do these school boards fold? why do they do that? why don't they say it's been adjudicated. they're going to do it and blank you, merry christmas. >> some of these small schools are afraid of litigation. and that's why the alliance will defend them for free at no cost to the school districts. they need to be informed. we hope they read the letters. they need to go to the school districts and tell them the truth. they can go to our website, all the fact sheets are on there. they can tell the truth to the school districts. once they're informed they usually back down like these last three. >> but i think it wasn't because of you and your fine

will there be a doctor shortage in america? from the beginning of the obama care debate i've been telling you it's not the cost of the health insurance that will be the main problem. yes, the cost is going to go higher for working americans, no question, but it is access to doctors that will vex americans in the future. in the next five weeks millions of americans will be added to the medicaid rolls. next year the congressional budget office predicts that 9 million more people will be receiving medicaid. just 69 percent of american doctors accept medicaid now. that number may go lower as government payments drop. if millions are added to the medicaid rolls and two-thirds accept those patients, the lines are going to be all over the place. joining us from oklahoma city, dr. keith smith who has a surgery practice and dr. brooks.

dr. brooks, you don't take medicaid health insurance at all, correct? >> that's correct, bill. >> why? >> i don't think i can do a thorough job. i don't believe in running people through my practice. i don't believe in volume practice and the new laws really would necessitate my pushing people through, not doing a thorough job. >> why couldn't you do a thorough job? there you are in the office and the people come in and they have health insurance and medicaid. what would prevent you from doing the usual good job that you do? >> it's a time factor. in order to get a good history, it takes ten or 15 minutes. the fees are so low that i couldn't afford to keep my doors open so i had to make a choice, either keep my doors open and practice medicine quickly or get rid of the insurance and practice medicine the way i want to. >> people come to you, they pay the full boat, you send them a bill and they write you a check,

there is no middle man at all helping them out. that's essentially your practice, right? >> that's correct. >> dr. smith, you do take medicaid patients. do you fear that the flood of new patients in oklahoma which is inevitable is going to impact on your practice? >> actually we don't take medicaid patients for the same reasons dr. brooks just explain. i prefer to give care that patients need rather than that that a bureaucrat tells me to give them. >> i apologize for that mistake. i was told that you did take it. so you don't take medicare. do you take private insurance? >> we will file some private insurance as a courtesy to the patients for all but the most abusive carriers. we do not take medicaid and don't anticipate. we would rather treat those patients free of charge than take that money, not only from the federal government and the state government but also dictating the type of care these people receive. >> both of you guys are shutting

out the poorest americans, the medicaid people who are going to be supplemented by the federal government under obama care. you both say, look -- >> no. >> don't show up at my door because i'm not going to do this. >> no. >> tell me where i'm wrong. >> if someone calls me and they need to be seen, it doesn't matter if they can pay me or not. >> you'll do it pro bono? >> sure. >> i'm not saying you're bad guys. if somebody comes in and can't pay you'll treat them. that's noble. what i'm trying to get across, both of you guys don't take it so the doctors who do take it are going to be flooded with more and more patients because of doctors like you guys. am i wrong? >> you're right. >> more physicians will -- >> it's a function of time. >> more physicians will stop seeing them. >> you say, dr. brooks, that more physicians are going to stop seeing them. why? why would they stop?

>> i would say that they would stop because there are a subset of physicians who really don't care to practice and to be dictated to by a set of people -- >> that's your opinion. do you share that opinion, dr. smith? >> yeah. absolutely true. that's why i don't deal with medicare either. i h i'd rather tell the patient, come on in. let's get you taken care of and leave that silly card. >> if both of you guys are right and more doctors say, you know what, i'm not going to get involved with this, i got a decent practice on my own, then you're going to squeeze all of these 30 million people who are enrolled on obama care if they can ever get the computer working into fewer and fewer doctors. that's a recipe for chaos, is it not, dr. brooks? >> it is, indeed. plus, as you've said, there are fewer and fewer doctors that will be practicing.

doctor that you had before. with medicaid like you said, bill, you're adding 10 million new focuses to a system that wasn't working well to begin with where you were having to wait for doctors, certainly specialists over long periods of time before you could get in. having a government program, passing a law does not necessarily mean you're getting people good care which is something critics of obama care have been saying and it's going to get worse. >> do you feel sorry for juan as i do because juan and his fellow political travelers, they want health care, good health care for the poor, and so do i, i do. but my theory, mary katherine, has always been that the way to get to that is not to destroy the entire medical system for everybody except those with big bucks as juan acknowledged. that's not the way to get there. i feel sorry because juan is

torn between the idealogical vision of free health care and good health care for the poor and a system that's falling apart. my question to you, mary katherine, is you feel sorry that juan is in this ethical dilemma. >> i have compassion for juan as a friend but i feel more sorry for people who are thrown into a program where they expect care and they don't get it because you're having a doctor shortage. doctors are not public utilities. they're people. >> juan, both mary katherine and i sympathize for you and feel bad for you because you're trapped in this vortex. >> am i trapped like that woman who wants to be a guy in canada? >> i hope not. >> i hope not, too. i appreciate the holiday compassion because everybody in the country deserves health
